可否請你幫我評估一下移民加國的成功率有多少.

個人背景資料如下:

我現在在美國唸mba.順利的話,明年summer或是fall可以畢業.
一共是18年的教育.
我英文算fluent.法文略懂一些. (不知道是要經過特別的語言考試認證嗎?)
沒有近親在加國.
工作經驗目前是三年.(是否要提出證明?)
又,是否要先在加國找到公司願意僱用你?

另外,聽說加拿大有通過下方這個法令:

Same-Sex Couples 
Equality under Canadian Immigration Rules

Canada has distinguished itself from most other nations by affording same-sex and opposite-sex couples equal treatment for immigration purposes.

Both marriage and common-law partnerships (opposite-sex and same-sex) are legally recognized in Canada for purposes of federal benefits and obligations (Modernization of Benefits and Obligations Act, June 2000). Canadian Immigration legislation conforms to this law.

Same-sex couples, residing abroad in a common-law or marriage relationship, can apply for Permanent Residence Status in Canada as a couple, subject to meeting eligibility criteria. Likewise, Canadian citizens and Permanent Residents can sponsor their same-sex partners.

In July 2003, a Draft Bill changing the definition of marriage in Canada to include same-sex marriages was referred to The Supreme Court of Canada. The Court is expected to decide its constitutionality very soon. The Bill is designed to provide equality for all Canadians by recognizing the unions of same-sex couples and at the same time protect freedom of religion by allowing officials of religious groups to refuse to conduct marriage ceremonies that don't fit their religious beliefs. The Draft Bill defines 「Marriage, for civil purposes」 as 「the lawful union of two persons to the exclusion of others」.

所以如果我移民成功後,是否能利用此法令替我朋友辦身份呢?
時間上會花更久嗎?
我朋友的個人資料背景和人幾乎相同,但她是在台灣唸mba.
還是二個人同時個自申請會比較有效率些?

而父母的話,是等我申請成功後再用親屬移民替他們辦身份嗎?
還是要跟我一同申請呢?

Dear Reader:

1. 若是您的分數達到67 分, 就不需在加拿大先有工作;

2.您目前的分數, 全靠英文 與法文考試得 分, 以及作了三年以上的工還是不到三年的工而定, 根據來信, 我無法判斷;

3. 申請移民, 一切資料都需文件證明;

4. 您先前的工作, 是否在NOC 分類的skill Type O, A 或B 中間, 也是要素;

5. 若是主申請人的分數不夠67 , 可能與配偶共同提出申請, 總共得分較高, 因為她/他會幫助加分, 但這有個先決條件, 就是他/她與妳/你必須或是夫妻, 或是同居人(Common-law partner), 才能同時提出申請, 或由您當主申請人, 或由對方當主申請人;

6. 辦理加拿大技術移民,目前是承認有正式婚姻關係與同居關係, 這種情形, 可共同提出申請;但請注意, 這沒說是同性的同居人;

7. 但是加拿大移民部在同性夥伴申請移民問題上, 也有了臨時政策, 詳情請見我的電子報.

總結, 若您指的是未婚的同性伴侶, 在申搬移民時共同提出申請, 似乎不可行, 可分開提出, 不過一但您先拿到身份, 再為對方辦手續的可能性是有的, 但也非絕對, 因為要符合一些條件, 由於相關法令較複雜, 我將於電子報中另作說明.

8. 最後, 關於您父母申請移民方面, 在申請表上, 說明了您要填寫Family mmember, 不論她/他與不與您同行, 這包括您的配偶(spouse), 同居人(common-law partner), 有實質夫妻關係的人(conjugal partner), 以及未成年的孩子, 沒有包含父母. 因此, 你可來了再申請父母依親, 不過您要有適當的加拿大境內收入, 包括利息都算.
